1. Your agreement with Plumb
These terms govern your use of the Plumb website and the Plumb application downloaded directly from us. Your contract is with Be a Goose, LLC, a California limited liability company, at 5716 Corsa Avenue, Suite 110, Westlake Village, CA 91362-7354. “Plumb”, “we”, “us”, and “our” mean that operator.
By downloading, installing, buying, or using Plumb, you agree to these terms. If you do not agree, do not use the application. You must be legally able to enter a contract where you live. If you use Plumb for an organisation, you confirm that you may bind it to these terms.
2. The free trial
Plumb includes one no-card trial per eligible Mac. The trial lasts 3 consecutive days and begins only when you start your first real monitoring session. Setup and calibration do not start it. The trial does not automatically become a paid plan and we will not charge you when it ends.
We use limited device information to prevent repeated trial claims. Reinstalling Plumb or deleting local data does not restart the trial. We may refuse or end a trial where we reasonably believe it is being abused.
3. Direct purchases and renewals
Direct purchases are processed by our payment provider. The price, billing period, currency, taxes, and any promotion shown at checkout form part of your order. Monthly and annual plans renew automatically for the same period until cancelled. You authorise the recurring charges disclosed at checkout.
A lifetime or founding-lifetime purchase is a one-time payment for Plumb. “Lifetime” means for as long as we make and support the product; it does not mean the purchaser’s lifetime or promise that every future product or paid feature will be included. This definition does not reduce any non-excludable consumer right.
You may cancel a subscription at any time through the online customer portal made available from Plumb or by contacting support@plumbcoach.com. Cancellation normally takes effect at the end of the paid billing period. Our separate Refund and Cancellation Policy explains refunds, statutory withdrawal rights, and billing errors.
Because Plumb includes a no-card free trial, purchases are final and non-refundable except where a refund is required by law or needed to correct a billing error. Cancelling a subscription stops future renewals but does not refund the current billing period.
4. Your licence
While your trial or paid entitlement is active, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Plumb for its intended purpose. A paid licence may be active on up to 2 Macs that you own or control. You may deactivate one Mac before activating another.
You may not sell, sublicense, share, rent, or commercially redistribute Plumb or a licence key; evade trial, payment, activation, or device controls; extract or publish non-public source code; interfere with the application or service; use Plumb unlawfully; or use our marks without permission. Rights that cannot lawfully be restricted, including applicable rights to reverse engineer for interoperability, remain unaffected.
5. Updates and service changes
Plumb periodically checks our update service for new versions. Updates may download automatically and install when Plumb quits. They may contain security fixes, compatibility changes, feature changes, or removals. Some updates may be required to keep using Plumb safely or with a supported macOS version.
We may improve, change, suspend, or discontinue features. If a change materially affects a paid consumer’s rights, we will give reasonable notice where practicable and provide any remedy required by law. Nothing in these terms permits us to avoid a legal obligation to supply conforming digital content or required updates.
6. Camera use and local-first processing
Plumb needs camera permission to monitor posture. Camera images and all posture data are processed only on your Mac and are not transmitted to us or third parties through normal use or diagnostics. Camera images are discarded during use, while posture data remains local. The Privacy Policy describes the limited other information used for licensing, payments, updates, support, and diagnostics.
7. Wellbeing, not medical care
Plumb is a general wellbeing and habit-support tool. It is not a medical device, does not diagnose, treat, cure, or prevent any condition, and is not medical or ergonomic advice. Its posture estimates and reminders may be incomplete or wrong. Stop using Plumb if it causes discomfort and seek advice from a qualified professional for pain, injury, disability, or medical concerns. Do not rely on Plumb in an emergency or safety-critical setting.
8. Third-party services
We use service providers for website and app delivery, payments, licensing, customer support, security, and diagnostics. They may process only the information needed to provide those services and have their own legal and privacy obligations. We remain responsible for our promises to you and do not make any provider the seller of Plumb.
9. Suspension and termination
You may stop using Plumb at any time. We may suspend or terminate access where payment fails, a subscription ends, a purchase is fully refunded or charged back, a licence is used beyond its device limit, or we reasonably believe these terms or the law have been materially breached. Where reasonable, we will give notice and an opportunity to fix the issue. Sections intended to survive termination, including intellectual property, liability, and dispute terms, continue to apply.
10. Ownership and feedback
Plumb and its software, design, content, and marks are owned by us or our licensors. These terms grant a licence, not ownership. If you send suggestions, you allow us to use them without restriction or payment, but you keep ownership of any rights you already hold and we will handle personal information under the Privacy Policy.
11. Warranties and liability
We will provide Plumb with reasonable care and skill and honour all rights that applicable law does not allow us to exclude. Otherwise, to the fullest extent permitted by law, Plumb is provided “as is” and “as available”. We do not promise uninterrupted operation, perfect posture classification, any health outcome, or compatibility with every camera, Mac, workplace, or future macOS release.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, lost profits, lost business, or lost data. Our total liability arising from Plumb will not exceed the amount you paid us for Plumb in the 12 months before the event giving rise to the claim or, for a lifetime purchase, the amount paid for that purchase. These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be limited.
12. Governing law and consumer rights
California law governs these terms, without regard to conflict-of-law rules. You and Plumb agree to exclusive jurisdiction and venue in the state and federal courts serving San Francisco County, California. If you are a consumer, this choice does not deprive you of mandatory protections or access to courts that the law of your home country gives you. Nothing in these terms limits statutory rights relating to faulty, misdescribed, unsafe, or non-conforming digital content.
13. Changes and contact
We may update these terms prospectively. We will post the revised date and give reasonable notice of material changes where required. Continuing to use Plumb after a change takes effect means you accept the revised terms, but changes do not retrospectively remove accrued rights.
